Introduction

Thank you for visiting Flexi-fencing website. This Throughout this document, the word “us”, “we”, “our”, “Flexi-fencing” and “Flexigo”, refer to us, Flexigo Ltd., doing business or trading as Flexi-fencing while the word “customer”, “client”, “you” and “your” refer to you as the customer.

Flexigo reserves the right to make changes to the site, related policies and agreements, the Privacy Policy and the Terms at any time. Such changes shall be effective immediately upon the linking of modified terms to the site. You are advised to check the site from time to time to check the update or changes to the said policies and agreements, the Privacy Policy and the Terms.

Account management

By registering an account you agree to provide true, current and accurate information about yourself. You must inform us immediately about any changes to the information that you provided when registering.

In using the site and Flexigo’s services (“the Services”), you agree to accept responsibility for all activities conducted through your account.

You are responsible for maintaining the confidentiality of your account and password and for restricting access to all your devices to prevent any kind of violations of your account.

You must inform us immediately if you believe that someone else knows your password, or if the password is being, or is likely to be misused in any way.

Your account is for personal use only. You must not share your access credentials with third parties.

Flexigo is not liable for any loss or damage arising from your failure to comply with this section.

Agreeing to all of the Terms does not entitle you to hold yourself as a representative of Flexigo, even if you are a business buyer.

User personal behaviour

Users of the site are allowed to post content including reviews and comments, to submit suggestions, ideas, questions, or other information, as long as the content is not illegal, obscene, abusive, threatening, defamatory, hateful, racially or ethnically offensive, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses or malware, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam". We are allowed, but not obliged, to review all content posted by any users on the site or forums. We reserve the right to edit, refuse to post or to remove any content that we believe is objectionable or violates this Agreement, the Terms, or applicable laws or regulations. We may remove any content at any time for any reason (including without limitationany which is offensive, politically biased or commercially oriented, upon receipt of claims or allegations from third parties), or for no reason at all, with or without notice. At any time without notice we may, at our discretion, suspend your access to the site and/or to Services, terminate your account or remove your content from any part of our site. We may also impose limits on your access to part of the site. You accept that any actions taken by us to improve the user experience of the site (including without limitation monitoring, reviewing, editing, removing or refusing to post materials) shall not create any duty towards you nor shall it form the basis for any liability against Flexigo.

Third-party links, sites and services

The site may contain links to third-party websites and resources of various kinds which are not owned or controlled by Flexigo. We do not have any control over those websites and resources. Flexigo excludes liability arising from your use of or access to them and if you access such third party websites or resources, you accept that you do so at your own risk.

Site and Services’ content

Flexigo is the owner or licensee of all intellectual property (“IP”) rights in the site and all content and materials included on the site.Those works are protected by copyright laws and treaties around the world.  All such rights are reserved.Users may not extract, copy and/or re-utilize any content from the site without Flexigo Ltd’s express written consent. Users are not also allowed to use any data mining, robots, or similar data gathering and extraction tools in relation to the site. Flexigo Ltd respects the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please contact Flexigo Ltd. immediately providing details of the infringement.

All content that you submit or post to the site, will be treated as non-confidential and nonproprietary, and by submitting or posting, you irrevocably grant Flexigo a royalty-free, worldwide, perpetual, irrevocable, and transferable licenceto use, copy, distribute, display, publish, perform, sell, lease, transmit, adapt, create derivative works from and to translate, modify, reverse-engineer, disassemble, or decompile such contentby any means.

Even though we try upload descriptions as meticulously as possible, You are aware that descriptions may be provided by third party materials and may be prepared by third parties over which Flexigo has no control. Images and descriptions of the Products on our site are illustrative only and computer displays of colours may not be accurate.

Prices are subject to change without prior notice. While we attempt to give you the most accurate and current information, sometimes products may not be available as listed. In that case the out of stock item(s) will be cancelled from the order and, where applicable, a refund will be applied for the cost of the regarding item(s).

All our product’s descriptions and prices will be up-to-date and as accurate as possible. However, errors about prices and descriptions may occur. If we discover a pricing error while processing your order and payment, we will immediately fix the problem before cancelling and refunding you for your order. We will also make sure to inform you about the error with your order as soon as possible.

All descriptions of products or product pricing are subject to change at anytime without notice at our discretion. We reserve the right to suspend, discontinue or alter any product at any time.

Liability

Use of the site is permitted on a temporary basis and Flexigo Ltd does not guarantee that the use of the site and of the Services will be uninterrupted, error-free or that the site or the used servers are free of viruses or other harmful components. We recommend all users of the site to ensure they have up-to-date software, including antivirus, installed. Some non-predictable events may happen beyond our control, such as (but not limited to) adverse weather, natural disasters or terrorist attacks. Under such conditions, Flexigo will always try to do its best to ensure and maintain its services, but will not be responsible for matters which are beyond its control.

Acceptance of order and payment

A customer who wants to purchase something using the site or the Services must be 18 years-old or older or a registered business, must be in possession of a valid credit/debit card issued by a licensed bank, or other means acceptable to Flexigo for payment, and must also provide personal and payment details that are warranted to be both valid and accurate about the requested information.

In placing an order with us, you authorize Flexigo to process a charge/charges on your credit/debit card in the amount of the total purchase price of your order. You also expressly authorize us to use personal information provided by you to perform appropriate anti-fraud and credit checks and to transmit or obtain information about you to or from third parties including without limitation credit reference or fraud-prevention agencies, which may keep a record of that information. Please refer to our Privacy Policy for further information about how we use your data.

Please note that all orders are subject to stock availability and confirmation of the order price and Items in your shopping basket does not constitute a reservation and all items may be purchased by other customers.

We accept payments made by cards Visa, MasterCard and PayPal for all international orders. When available, orders shipped to China can also be paid using major cards supported by Alipay. We also accept payments made by bank transfer, as indicated in payment options in the site.

By placing an order using a Credit/Debit card, you confirm that the Credit/Debit card(s) is yours or that you have been authorized by the owner to use it. If your card issuer refuses to authorize payment to Flexigo, we will not be liable for any delay or non-delivery.

For all other payments, payment will only be debited and cleared from your account once your order has been accepted and dispatched.</p>

Our payment processes follow International security standards set down by the Payment Card Industry. In the absence of negligence on our part, we will not be liable for any loss you may suffer if any third party procures unauthorized access to any data you provide when using our site or Services.

Shipping

Orders for delivery to Hong Kong are not subject to taxes and duties.

Orders from countries served on a Delivery Duty Paid (DDP) basis will incur relevant taxes and duty and will be included in the final purchase price. This one-step process is for your convenience. Please note that the import tax and duty charges willbe passed by us to the relevant local Customs authorities and are non-refundable in the event of a return or exchange. However you will only be charged taxes and duties once for exchanges.

Customers placing orders from countries to which we deliver and served on a Delivery Duty Unpaid (DDU) basis will only be charged for the price of the product(s) purchased (excluding taxes and duties) and the delivery costs. Customers will be responsible for the payment of all import tax and duties levied by the country to which the products are shipped and payment of the said tax and duties is necessary for the release of the products ordered from the Customs on arrival. In all cases, whether orders are DDP or DDU, Customers are responsible for compliance with all laws of the country to which the products are shipped.

The estimated delivery date will where possible be indicated on the site.

Where possible, Flexigo will notify you the tracking number of your shipment as soon as available from shipping operator.

Orders with multiple items may be shipped in multiple different shippings, depending on the suppliers involved and on the immediate availability in stock of purchased items. Therefore, you may receive purchased items in different moments. When multiple shipments apply, you will be notified by Flexigo. In case of material delays vs. the communicated shipping time, you will be notified by Flexigo. .

Guarantees

Some of the Products we sell to you come with a manufacturer's guarantee. For details of the applicable terms and conditions, please refer to the manufacturer's guarantee provided with the Product.

We only supply the Products for personal and private use . You agree not to use the product for any commercial, business or (unless we give prior written consent) resale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity. Flexigodoes not accept any liability of whatever nature, whether in contract, tort or otherwise, for your use of the Products. Flexigo does not however in any way exclude or limit our liability for anything which we are not permitted to exclude by consumer or similar laws. If you are a commercial customer any resale of the Products must be subject to a separate commercial agreement agreed with us in advance. Any manufacturer’s guarantee will be void and cancelled in the event of any breach of these Terms.

Indemnity and waiver

At our request, you agree to compensate us fully and hold Flexigo Ltd (including its officers, directors, agents, affiliates, licensors, and suppliers), harmless from and against all losses, liabilities, claims, expenses, damages and losses, including legal fees, arising from any breach of the Terms by you. This includes the use of the site by any other persons using your account caused by your action or inaction. Where you breach the Terms, any delay by Flexigo in exercising its rights does not constitute a waiver or its rights or remedies or of any other rights or remedies.

Return policy and procedures

If you're not 100% satisfied in any way with an item you've received, please let us know emailing support@flexi-fencing.com within 10 calendar days of receipt.

Returns can only be made once authorized by Customer Support.

If you have ordered the wrong product, then you can still return for a full refund but please note that the items must be unopened and unused and you will have to bear postage costs.

We are happy to refund postage costs if our examination demonstrates that the item is defective or sent due to our error. If you wish to cancel because of a materially late delivery, you must email Customer Support. Generally we will try to allow such cancellation but if we do, after products have been dispatched to you or you have received them, you must return them to us and the cancelled goods will remain our property.

In order to process your returns as quickly as possible, all returns must include:

  • A copy of your delivery note or your order number
  • Return authorization (obtainable from Customer Support)
  • Reason for return

Please ensure that items are packed securely to prevent any damage in transit. We also suggest sending via registered or insured post so the parcel can be traced.

For credit card refunds, please note we can only refund the total cost of goods, not tax, duties or shipping costs which have been paid to a third party. Refunds will be made by the method you used for payment. We may reduce your refund if the items are opened or used or if you have handled them in a way which would not be permitted in a shop.

If there are shipping charges to be refunded we will offer you a credit off your next purchase to cover this reimbursement

Flexi-points

Flexi-fencing may offer loyalty points “Flexi-points” when purchasing products or conducting other actions on the site, according to the rules and policies published from time to time on the site. When displaying a product, the site shows the number of points that you can earn by purchasing it. This number is determined by Flexigo ltd in its sole discretion, and may be changed at any time without prior notice.

Flexi-points are offered at Flexigo’s sole discretion. Flexigo has no obligation to offer points. Flexi-points can be used according to the rules published on the site and only to purchase products shown on the site as purchasable by redeeming points. Such products may be available for a limited period of time and may be changed frequently at any time without prior notice. Redemptions for product purchases are limited by product availability.

Flexi-points cannot be converted to cash.

Air tickets

Flexi-fencing may offer air tickets that can be purchased by redeeming Flexi-points.

Tickets are subject to availability and can be withdrawn or varied without notice. A purchase of a ticket is not confirmed until you receive an invoice for the ticket. The number of points required to redeem is subject to change at any time until the redemption transaction is completed. The number of points shown isfor one ticket purchasefor one person, unless otherwise stated.

Should you have any special requirements such as special meals or seating requests, please communicate them in your ticket request on Flexi-fencing website.

Please include any frequent flyer membership details for inclusion in your booking. Please check your frequent flyer program for the specific terms for your membership. We cannot guarantee that the supplier will credit you with points for your booking.

Tickets purchased by redeeming Flexi-points are not transferable to other persons and are not refundable. Should you want to cancel your ticket or change the booking, you must immediately notify Flexi-fencing Customer Support via email at support@flexi-fencing.com and any other relevant parties as indicated in your booking confirmation. We will use our best efforts to satisfy your request, and notify to you any cash payment you will have to make. Cash payments can be made by any of the accepted payment methods on the website or with Flexi-points, as notified to you by Flexi-fencing Customer Support. Please note that in some cases the extra cash cost can exceed the value of the originally ticket purchased by redeeming Flexi-points.

We act only as agent when providing air-tickets to you. To do so, we leverage on well established travel operators, who will actually make the reservation, according to information provided by you; they make the booking and purchase the ticket on your behalf. Additionally, we will use your redeemed Flexi-points to provide the necessary funds to execute the purchase transaction. We have no responsibility for these third party agency services nor do we make or give any warranty or representation regarding their standard. All bookings are made on your behalf subject to the terms and conditions and limitations of liability imposed by travel operators and service providers. Your legal recourse is against the specific provider and not us. If for any reason, any travel service provider is unable to provide the services for which you have contracted your remedy lies against the provider and not with us.

We do not accept any liability of whatever nature, whether in contract, tort or otherwise, for the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control. Under circumstances where liability cannot be excluded, such liability is limited to the value of the purchased travel agreements.

All airline tickets must be issued in the name of the passport/photo identity holder. An incorrect name on a booking may result in an inability to use that booking and the booking being cancelled. Any errors in names, dates and timings on your documentation will be your responsibility if not advised at the time of booking. It is your responsibility to collect all travel documents from us prior to travel. As soon as available for collection, we will send the electronic air ticket to you via email to your email address registered on the website.

It is your responsibility to ensure that you have valid passports, visas and re-entry permits that meet the requirements of immigration and other government authorities. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility. All travellers must have a valid passport for international travel and many countries require at least 6 moths validity from date of return and some countries require a machine-readable passport. If you need information regarding visa and other travel document requirements for your trip please let us know. We can obtain such information from an external visa advisory service provider on your behalf. For this service some fees may apply. We do not warrant the accuracy of such information and accept no liability for any loss or damage which you may suffer in reliance on it.

If you are travelling to the United States of America, please read https://esta.cbp.dhs.gov for information regarding compulsory pre-registration for their visa waiver program. Please note, you may not meet the requirements of ESTA and may be required to obtain a visa.

You must ensure that you are aware of any health requirements for your travel and ensure that you carry all necessary vaccination documentation. Please check with your local doctor or specialist vaccination clinic.

Force Majeure

Flexigo will not be responsible for anything caused directly or indirectly by force majeure or any other event which is beyond our control and which is not preventable by reasonable diligence on our part.

Transfers

We may transfer our rights and obligations under a Contract to another organization, but this will not affect your rights or our obligations under these Terms. You may only transfer your rights or your obligations under these Terms to another person if we agree in writing.

Communications

References in these Terms to “writing” shall include email. Any notice or other communication given by you to us, or by us to you, shall be in writing and shall be sent by email or may as an alternative or in addition be delivered personally, sent by post or courier delivery service. In proving the service of any notice, it will be sufficient to prove that any letter was properly addressed, stamped and posted, that any e-mail was sent to the specified e-mail address of the addressee; or that a delivery receipt was obtained. The above shall not apply to the service of any proceedings or other documents in any legal proceedings.

Law and jurisdiction

All the Terms and all our policies are governed by and construed in accordance with Hong Kong SAR law. The courts of Hong Kong SAR will have non-exclusive jurisdiction in the event of any dispute or claim associated with these Terms.

Nothing in the Terms is intended to affect your rights under consumer or similar laws in Hong Kong SAR beyond what is permitted by law.
